Exceptions and Waivers
A Bilingual exception needs to be submitted if your district/charter school has an insufficient number of bilingual teachers to implement the bilingual program as stated in 19 Title Texas Administrative Code (TAC) Chapter 89 Subchapter BB. Commissioner's Rules Concerning State Plan for Educating Limited English Proficient Students. An English as a second language (ESL) waiver needs to be submitted if your district/charter school does not have a sufficient number of ESL teachers to implement the required ESL program as required in the aforementioned TAC. Both of the forms listed below require MS Word.

The 2007-2008 transmittal forms for a Bilingual Exception and/or an ESL Waiver must be sent electronically to Susie.Coultress@tea.state.tx.us
and the signature pages (page 7 of the Bilingual Exception) and (page 11
of the ESL Waiver) will be completed and mailed to the
